TERMS AND CONDITIONS – COLOR KAHAR

IMPORTANT NOTICE: These Terms & Conditions govern your use of the Color Kahar mobile application, website as well as other related products and services. They are designed to comply with the requirements of the Apple App Store, Google Play Store, and applicable consumer protection and data protection laws. Please read these Terms carefully before accessing our Services. By creating an account, placing an order, or accessing the app website and related products and services, you agree to be bound by these Terms.

1AGREEMENT TO OUR LEGAL TERMS

1.1 Terms of Use

These Legal Terms constitute a legally binding agreement between you (as defined in section 1.2) and Color Kahar Private Limited (or referred to as "Color Kahar", "Company", "we", "us", or "our"). We operate and provide the website www.colorkahar.com (the "Site"), the Color Kahar mobile application (the "App"), as well as any other related products and services (collectively, the "Services") that reference or link to these terms, including all other terms, policies, notices, guidelines, and forms referenced herein or otherwise available on the Services or by hyperlinks (collectively, the "Legal Terms").

1.2 Definitions of Parties

The terms "you", "user", or "customer" refer to any person, whether personally or on behalf of an entity, who:

  • visits or uses any part of our Services,
  • Browses, places an order or makes a purchase through our Services,
  • registers for an account on our Services,
  • uploads content or interact with our product customization/ordering tools, or
  • otherwise communicates with us, such as requesting information or engaging with our customer support or promotional content or social media etc.

Whether you are acting in a personal capacity or on behalf of a company or other legal entity, you confirm that you have the authority to accept and be bound by the Legal Terms.

1.3 Target Audience, Age Eligibility and Use by Minors

Color Kahar app (including Services) is intended for general audiences and is not designed for children. Our Services are intended for individuals aged 18 years and older (i.e. age of majority). We do not knowingly allow children under the age of 18 to use the Services independently.

However, use of our Services by individuals under the age of 18 (i.e. age of minority) is only permitted if access to the Services is operated by, or allowed access under the supervision of, a parent or legal guardian at all times. If you are a minor, you may only use the Services after your parent or legal guardian has reviewed and agreed to these Legal Terms on your behalf and agree to take responsibility for your actions and any charges associated with your use of the Services and/or purchases.

1.4 Account Registration

You must register an account for complete usage of our Services. By doing so, you agree to:

  • Keep your login credentials—including email, OTPs, and social login tokens—confidential;
  • Notify us immediately if you suspect unauthorized access to your account;
  • Accept full responsibility for any action taken from your account, whether by you or someone else using your credentials;
  • Avoid sharing your account with others. Shared accounts may be suspended or terminated.

We may reclaim or block any username that we deem offensive, misleading, or in violation of these terms.

1.5 Acceptance of Terms

By accessing or using any part of the Services (e.g. visiting our website, installing or launching the App, browsing, customizing products, registering an account or placing an order etc.), you confirm that you have read, understood, and agree to be bound by these Legal Terms, including our related policies such as the Privacy Policy, Refund & Return Policy, and Shipping Policy. If you do not agree with any of these, you must immediately discontinue use of the Services.

  • On the first launch of the Color Kahar mobile app, clicking the "Let's Start" button again constitutes your agreement to these Terms and Conditions.
  • When placing an order through our App or website, clicking the "Order" or "Checkout" button also signifies that you accept and agree to be bound by these Terms.

These Terms are always accessible from the app and on our website (can also be printed) or sent to you upon your request.

These Terms apply equally whether you access our Services through our website, Android application, or iOS application or other official mediums.

1.6 User Representations

By using the Services, you represent and warrant that:

  • (a) All information you provide during registration or use is accurate and complete;
  • (b) You will keep your information updated as needed;
  • (c) You are either above 18 or using the Services under the supervision of a legal guardian who has agreed to these Terms;
  • (d) You will not access the Services via automated or non-human means (e.g., bots, scripts);
  • (e) You will not use the Services for any unlawful or unauthorized purpose; and
  • (f) You will comply with all applicable laws and regulations.

If any of the above is found to be false, we reserve the right to suspend or terminate your access, block future use, or take legal action if necessary.

1.7 Contact Information Accuracy

To ensure uninterrupted service and delivery, you are required to maintain a valid and accessible email address and contact number associated with your account. These are essential for receiving updates from us such as order confirmations, delivery updates, and important service notices. If we determine that the email address or phone number provided is invalid, inaccessible, or fraudulent, we reserve the right to suspend or terminate your account without prior notice.

1.8 Updates to Legal Terms

We may update or revise these Legal Terms at any time. While we may notify you of material changes via email, app notifications, or announcements, it remains your responsibility to periodically review these terms. All changes become effective immediately upon posting, and your continued use of the Services after such posting constitutes your acceptance of the revised terms. We recommend that you print a copy for your record.

2WHAT WE DO

2.1 About Color Kahar

Color Kahar is a Pakistan-based platform that offers a personalized photo product creation service. Through our Services, users can design and upload photo customized products (such as photobooks, prints, mugs, calendars, and more), place orders, and have these items printed and delivered to addresses within Pakistan.

Our Services allow you to do the following (but are not limited to these actions):

  • Browse our product catalogue
  • Create and customize photo products
  • Place and manage orders
  • Communicate with our support team
  • Contribute to public mediums
  • Access photo editing and product customizing tools
  • Receive product updates, delivery updates, Service updates, and promotional notifications

2.2 Geographic Availability

At present, our services are only available in territorial boundaries of Pakistan. If an order is placed from, or intended for, a delivery outside of Pakistan, we reserve the right to cancel it without notice. We may expand our service territory in the future, in which case our delivery policies and legal terms will be updated accordingly.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

3OUR INTELLECTUAL PROPERTY

3.1 Ownership of Content and Marks

We are the owner and the licensee of all intellectual property rights in our Services - including but not limited to all source code, databases, functionality, software, website design, product designs/templates, mobile app, photographs, video, audio, graphics, text, and written content (collectively, the "Content")

This also includes all trademarks, service marks, trade names, and logos used or displayed in the Services (collectively, the "Marks").

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) under the laws of Pakistan as well as international treaties. The Content and Marks are provided in or through the Services 'AS IS' for your personal, non-commercial use only.

3.2 Reverse Engineering and Tampering

You may not reverse engineer, re-engineer, disassemble, decompile, alter, copy or attempt to extract the source code or any part of our Services, Contents and Marks. You are also strictly prohibited from integrating, modifying, or tampering with our intellectual property and Services including software, mobile app, or systems through any unauthorized third-party tools or automated means.

3.3 Technical Protections

We may implement technical measures to safeguard our intellectual property, including encryption, license controls, watermarking, or access restrictions. You are strictly prohibited from attempting to bypass, disable, or interfere with these technical protections or assist others in doing so.

3.4 Permission Requests

If you wish to use any part of the Services, Content, or Marks beyond the permissions explicitly granted here, you must request written authorization by emailing us at support@colorkahar.com. All such requests are subject to approval at our sole discretion. If permission is granted, you must clearly attribute ownership to us (Color Kahar) and retain any copyright or proprietary notices when displaying or distributing our Content or Marks.

3.5 Breach and Termination

Any unauthorized use, duplication, or misuse of our intellectual property is a direct violation of our Legal Terms and will result in the immediate termination of your access to the Services and may also lead to legal action or claims for damages.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks.

4USER LICENSE TO ACCESS OUR SERVICES

4.1 Grant of License

Subject to your ongoing compliance with these Legal Terms, including the section titled "Prohibited Activities", we grant you a limited, non-exclusive, non-transferable, revocable license, without the right to sublicense, to access and use our Services strictly:

  • As necessary to benefit from the Services you have properly obtained access to, and
  • Solely for your own personal, non-commercial use.

You may download or print a single copy of any portion of the Content to which you have lawful access, provided that such use is solely for personal reference and does not violate these Terms.

Except as explicitly permitted in this section or elsewhere in our Legal Terms, you may not:

  • Copy, reproduce, aggregate, upload, post, encode, transmit, license, modify, adapt or republish any part of our Services, Content or Marks;
  • Display, distribute, or publicly perform our Content or Marks;
  • Integrate or combine any portion of our website, app, or software with third-party tools or platforms;
  • Use any Content or Marks for commercial purposes;
  • Sell, license, sublicense, or otherwise exploit any part of the Services;
  • Use our Marks or branding in any way that implies affiliation or endorsement;
  • Exploit our Services, Content and Marks for any commercial purpose whatsoever, without our express prior written permission;
  • Modify or create derivative works based on our Services or Content;
  • Use automated tools to extract or scrape data or visuals from the Services.

4.2 Requests for Additional Use

If you wish to make any use of the Services, Content, or Marks beyond what is expressly permitted here, you must obtain our prior written permission. You may request such permission by contacting us at support@colorkahar.com. Approval, if granted, will be subject to conditions at our sole discretion including clear attribution of ownership to us. You must retain any copyright or propriety notices when displaying or distributing our Content or Marks. We reserve all rights not expressly granted in and to the Services, Content, and Marks. Any unauthorized use of the Services, Content, or Marks constitutes a material breach of these Legal Terms and may result in the immediate termination of your access and potential legal action.

5SUBMISSIONS RIGHTS

5.1 Ownership of Submissions

If you choose to send us any form of direct communication—including but not limited to questions, feedback, suggestions, product reviews, ideas, business proposals, or any other unsolicited content (collectively, "Submissions")—you agree that such Submissions become the sole and exclusive property of Color Kahar upon receipt.

You hereby irrevocably transfer and assign to us all intellectual property rights, titles, and interests, including any intellectual property rights, in and to such Submissions, and you waive any and all moral rights you may have in those Submissions.

We shall be free to use and exploit Submissions for any lawful purpose, commercial, promotional or otherwise, without acknowledgment, notice, or compensation to you.

5.2 No Obligation

You acknowledge that we are under no obligation to:

  • Keep any Submission confidential;
  • Provide any response or feedback regarding your Submission;
  • Compensate you for any use of your Submission;
  • Attribute the Submission to you publicly or privately.

5.3 Clarification – Not Product Content

This clause does not apply to photos uploaded or personalized content uploaded by you for the creation of custom products. Such content is governed by our Privacy Policy and is used solely for the purpose of order fulfillment unless additional consent is provided (such as marketing and promotional use).

5.4 Compliance Reminder

All Submissions must comply with our Prohibited Activities section. Any content deemed abusive, illegal, misleading, or violating third-party rights may be deleted and could result in account suspension or other actions.

6USER CONTRIBUTIONS AND CONTENT LICENSING

6.1 Ownership and Responsibility

You may choose to, or be invited by us, to publicly chat, contribute to, or participate in blogs, message boards, online forums, social media and other functionality (including functionality of our Services) during which you may create, submit, post, upload, display, transmit, publish, distribute, or broadcast content and materials on or outside our Services, including but not limited to text, writings, video, audio, photographs, music, graphics, comments, reviews, rating suggestions, personal information, or other material (collectively 'Contributions'). You retain full ownership of all contributions you upload, submit, or share through our Services. By uploading contributions, you explicitly represent and warrant that you own or control all rights necessary and that your uploads do not infringe third-party rights (including but not limited to intellectual property, privacy, or any applicable law). You further warrant that an uploaded contribution does not violate any laws, regulations, social norms, or accepted morality standards, including (without limitation) content containing pornography, exploitation, discrimination, criminal activities, violence, or hatred. Any Submission that is publicly posted shall also be treated as a Contribution. You understand that Contributions may be viewable by other users of the Services.

6.2 Indemnity

You expressly agree to indemnify and hold us harmless against any claims, liabilities, damages, losses, and expenses arising from or related to your uploaded contributions breaching these warranties, third-party rights, or applicable laws.

6.3 Licensing – Public Contributions

When you publicly post Contributions (e.g., comments, reviews, messages, forum interactions, or tagging our service on any media platform including social), you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully paid, worldwide right and license to use, copy, reproduce, publicly display, modify, translate, distribute, reformat, sell, resell, publish, broadcast, retitle, store, publicly perform excerpt(in whole or in part) incorporate into derivative works, and otherwise exploit your Contributions for any purpose, commercial, advertising, or otherwise, to prepare derivative works of, or incorporate into other works, your Contributions, and to sub-license the licenses granted in this section. Our use and distribution may occur in any media format and through any media channels. This license includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide.

6.4 Licensing – Personalized Product Content (Restricted License)

Content specifically uploaded for the creation of personalized products (such as photobooks, prints, calendars, mugs, etc.) is subject to an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully paid, worldwide right and license strictly for fulfilling your orders. This license permits us (and our affiliated production houses) to copy, print, store temporarily, modify (e.g., cropping, color adjustment) and view your content for creating your personalized products and Service fulfilment. We do not use or display such content publicly or in marketing materials unless you explicitly consent to this usage. No personal photo data is retained beyond reasonable requirements for fulfilling orders and providing our Services.

6.5 Marketing and Promotional Usage (Consent and Opt-Out)

We may showcase your publicly shared Contributions in our marketing or promotional materials, including online galleries or social media, with or without personal identifier as per our requirement. Your finalized personalized products, plus contributions used for making them, may only be shared if we have your consent.

6.6 Warranties Regarding Public Contributions

When submitting public content (e.g., reviews, social tags, posts), you confirm that:

  • You own or have rights to share the content;
  • No individual in the content is included without proper consent;
  • Your content is not false, obscene, defamatory, or illegal;
  • Your content doesn't violate intellectual property rights;
  • Your content does not promote harassment, abuse, hate speech, or violence.

7PRODUCT QUALITY, ACCURACY, AND USER RESPONSIBILITY

7.1 Product Quality Assurance

We guarantee that all delivered products will have satisfactory quality and performance and will be suitable for the intended purpose as is generally expected from similar goods. If you believe your product does not meet these standards or there is a defect, you must notify us within 7 days of receiving your order for clear defect. Otherwise, the product is deemed accepted.

7.2 Color Accuracy Disclaimer

While we strive to accurately represent how your final product will look through on-screen previews, variations in color, brightness, and contrast between your digital images and the final printed product are normal. These variations can result from differences in screen calibration, lighting conditions, printing materials, and production processes. Such variations are explicitly acknowledged by you as acceptable and do not constitute defects unless a significant error has occurred on our part.

7.3 User Responsibility and Image Quality

You acknowledge and accept full responsibility for the quality of the images you upload for use in product creation tools of our Service. We are not responsible for subpar print results arising from low-resolution, blurry, pixelated, or otherwise poor-quality images provided by you.

You also acknowledge and accept full responsibility for the accurate placement, cropping, zooming, and alignment of your uploaded photos in the provided product customization tools and sections of the Services. Although we offer tools like auto-cropping, auto-layout, zoom assistance, and previews for your convenience, it remains your obligation to thoroughly review and confirm your product layout before submission.

You also acknowledge and accept full responsibility for accurate spellings of names, titles and captions. We will not be responsible or liable for errors due to improper photo placement, zoom, cropping, layout or textual issues overlooked by you during the preview and approval processes on our Services.

By confirming and submitting your order, you accept and approve the personalized products as presented in the product preview.

7.4 Size, Cropping, and Material Variations

All product dimensions (including print sizes, margins, borders) are approximate and minor deviations may occur due to the customized production processes. Similarly, slight variations in cropping, positioning, and alignment between the digital preview and the final printed product are considered normal, acceptable, and not defects.

Additionally, variations resulting from different printing materials, textured materials or finishes are expected and explicitly acknowledged by you as acceptable and normal occurrences. These variations do not constitute defects and are not grounds for refund, replacement, or compensation.

7.5 Customer-caused Damage and Misuse

We explicitly disclaim any responsibility or liability for product damage resulting from misuse, improper handling, accidents, neglect, modifications, or normal wear and tear by the customer. Such customer-caused damage will not be eligible for refunds, repairs, replacements, or any compensation.

7.6 Returns and Remedies for Defective Products

If your delivered product is defective or materially different from your confirmed order, you may request a repair, replacement, or refund. To do so, you must notify us within 7 days of receiving the product and provide clear video proof of unboxing at the time of receipt. Minor variations (e.g., color differences, alignment shifts, material finish including those discussed above and others) are not considered defects and do not qualify for remedies.

If your claim is verified, we may offer a reprint, voucher, or refund (only if other remedies not possible or viable) at our discretion. For full details, please refer to Section 9 (Refund, Return & Cancellation Policy).

8PAYMENT POLICY

8.1 Accepted Payment Methods

We accept the following forms of payment for orders placed through our Services:

  • Credit/Debit Cards (via United Bank Limited (UBL) and other authorized processors)
  • Jazz Cash / Easypaisa (Via Mobile Wallet Integrations)
  • Cash on Delivery (COD) (processed via courier partners such as TCS or M&P)

All payments are processed securely by third-party payment providers. Color Kahar does not store your complete payment details, and your data is handled in accordance with the respective payment gateway's privacy policies and terms. It is your responsibility to check and agree to the payment gateway's policies and terms.

8.2 Timing of Payment

For all prepaid methods (Credit card and Jazz Cash), full payment is charged immediately at the time of order placement due to the personalized nature of our products.

For Cash on Delivery orders, full payment is required at the time of delivery. Failure to pay upon delivery may result in account suspension or denial of future COD services.

8.3 Order Confirmation & Acceptance

Once you place an order and your payment is received (or COD is selected), you will receive a confirmation email. For certain orders, you may also receive a verification call from our team.

Please note that receipt of this email and/or phone confirmation does not constitute acceptance of your order. Your order is considered accepted only once it has been dispatched. We reserve the right to reject or cancel any order before dispatch, even after payment has been received.

8.4 Pricing, Taxes, and Fees

All prices are shown in Pakistani Rupees (PKR) and are inclusive of applicable taxes (e.g., GST), unless otherwise stated. Shipping fees will be displayed during checkout, where applicable.

We currently only offer delivery within Pakistan, so import duties or international tax obligations are not applicable at this time. If we expand to other regions in the future, additional duties or fees may apply based on your shipping destination and will be your responsibility.

8.5 Discounts and Promotions

From time to time, we may offer discount codes, promotional prices, or special bundles. Each promotion will be subject to its own terms and conditions, including expiration dates, product eligibility, or minimum spend requirements.

We reserve the right to decline the use of a discount code, revoke it in cases of misuse, or apply standard pricing once the offer period has expired or any other reason befitting for such activity.

8.6 Pricing Errors and Cancellations

We make every effort to ensure pricing is accurate. However, we reserve the right to correct any errors or inaccuracies in pricing, even if payment has already been processed. If such an error is discovered prior to dispatch, we may cancel your order and notify you accordingly or offer to adjust the price before proceeding.

We also reserve the right to limit or cancel orders at our discretion, especially in cases of suspected fraud, bulk/reseller behavior, or repeat abuse of promotional offers.

9REFUND, RETURN, AND CANCELLATION POLICY

9.1 No Cancellation Policy (Personalized Products)

Due to the customized and personalized nature of our products, all sales are final from the moment you submit your order. No cancellations, modifications, or alterations are permitted after your order has been placed. We strongly encourage you to carefully review all details, designs, texts, and photos thoroughly before confirming your order.

9.2 No Returns for Customer Errors or Buyer's Remorse

We explicitly do not accept returns or offer refunds in cases involving customer mistakes, such as typos, incorrect photo selection, layout or design errors, or due to changes in personal preferences (buyer's remorse). It remains your responsibility to verify the accuracy of your product design and information prior to placing your order.

9.3 Reporting Defective or Incorrect Products

In the rare event that your product is defective, or incorrect product you must notify us within seven (7) days from the date of product receipt. To submit a claim, you are required to provide clear, comprehensive video proof documenting the unboxing and clearly illustrating the defect or issue. Claims submitted without such proof, or beyond the 7-day window, will not be eligible for consideration.

9.4 Remedies for Verified Claims

Upon verification and approval of your claim, our primary remedy will be to provide you with a reprint of the defective product or offer an equivalent voucher discount for future orders, solely at our discretion.

Refunds will be offered when it is impossible or impractical to provide a reprint or voucher discount or any other reasonable remedy.

9.5 Return of Defective Products

We reserve the right, at our sole discretion, to request the return of defective or incorrectly produced items. If we require a return, we will clearly communicate instructions, and you may have to cover the cost of return. You agree to cooperate with the return process to remain eligible for remedy or refund as specified above.

9.6 Statutory Consumer Rights

Nothing in this section is intended to limit or exclude any mandatory consumer rights available to you under applicable law.

10DELIVERY POLICY

10.1 Order Processing and Production

Once your order is placed and payment is confirmed on our Services, we proceed with production. We typically begin processing your order immediately. Production timelines may vary depending on the product type, your location, order volume, and courier availability.

While we aim to dispatch all orders within the indicated delivery window, all delivery timeframes provided on our platform are estimates only and not guaranteed delivery deadlines.

10.2 Estimated Delivery Times

Delivery durations may be affected by a range of external factors including courier delays, national holidays, strikes, natural events, or seasonal production spikes. Such events are outside our control and do not constitute breach of service. Durations may also be affected due to internal factors such as unusual production spikes, maintenance of production facilities and equipment or other activities. In such cases our top priority will be to dispatch your products as soon as reasonably practicable.

The estimated delivery period may be confirmed via email or phone call. If your order includes multiple products, we may ship them together; in such cases, the longest individual product lead time will apply.

10.3 Partial Deliveries

We reserve the right to fulfill and ship your order in multiple shipments or partial deliveries, depending on product readiness or logistics conditions. There will be no additional cost to you for such partial deliveries.

10.4 Delivery Costs and Locations

Delivery charges will be clearly displayed at checkout and added to your total before you complete payment, unless the cost is already included in the product price or you qualify for free delivery at our discretion. We currently only deliver within Pakistan. International deliveries and customs clearance responsibilities do not apply at this time. If international delivery is introduced in the future, our delivery policy will be updated accordingly.

10.5 Address Accuracy and Non-Delivery

You are responsible for ensuring the delivery address you provide is complete and accurate. We will not be liable for delays, failed deliveries, or lost packages resulting from incorrect, outdated, or incomplete address details.

If a package is returned due to an address issue, you may be responsible for reshipping fees or order cancellation if reshipment is not possible.

10.6 Risk of Loss and Ownership

Ownership and risk of loss for your order transfers to you once the product is handed over to our logistics partner or courier. From that point forward, you are responsible for the package.

We partner with reputable third-party logistics providers (such as TCS and M&P) to handle delivery.

10.7 Damaged Shipments and Courier Claims

We take great care in packaging our products securely. However, once a product is handed over to the courier, we are not responsible for any damage that occurs during transit.

You are advised to inspect your package at the time of delivery. If the product appears visibly damaged due to mishandling in transit, you should report the issue immediately to the courier service and initiate a claim directly with them

Once a product is handed over to our logistics partners, you acknowledge that we are not liable for delays, mis delivery, or damage caused during transit.

You agree to indemnify and hold us harmless for any third-party delivery disputes including physical product damages, unless caused solely by our internal error.

10.8 Delivery Error and remedies

We use reasonable technical and operational measures to ensure accurate processing, packaging, and delivery of all orders. However, due to the nature of human and system-based operations, inadvertent errors may occasionally occur.

In the event an order is delivered incorrectly due to an operational error attributable to Color Kahar, Color Kahar's sole obligation and the user's exclusive remedy shall be limited to either (i) reprinting and redelivering the affected order, or (ii) providing a voucher up to equal value of order or refunding the amount paid for that order, at Color Kahar's discretion.

Color Kahar shall not be liable for any direct, indirect, incidental, consequential, emotional, reputational, or privacy-related damages arising from such delivery error.

11PERSONAL DATA

11.1 Data Protection and Policy Reference

We are committed to protecting your privacy and handling your personal information with care and transparency. We only access the minimum amount of data required for providing our Services and process it in accordance with your privacy settings and our Privacy Policy. You can disconnect your linked account at any time by adjusting your app settings or contacting us directly. 12SYSTEM SECURITY, AVAILABILITY & LIMITATIONS

12.1 No Guaranteed Uptime

While we strive to maintain uninterrupted access to our Services, Color Kahar makes no guarantee of 24/7 system availability. From time to time, you may experience interruptions due to scheduled maintenance, system updates, peak loads, or unforeseen technical issues.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice. We are not liable for any delays, losses, or inconvenience resulting from your inability to access the Services during these periods.

In the event of any downtime, we will make reasonable efforts to fulfill confirmed orders already in production as soon as service is restored. However, no compensation or liability will be provided for delays caused by service interruptions.

12.2 Not a Backup or Storage Service

Our Services are not intended to function as a permanent photo storage or backup solution. While you may upload images or save project drafts within the platform for your convenience, we do not guarantee ongoing storage or long-term accessibility of any user content.

You are solely responsible for maintaining your own backup copies of all images, designs, and project data. Color Kahar is not liable for the loss, deletion, corruption, or inaccessibility of any files, regardless of cause.

12.3 Data Security and Liability

We implement reasonable security safeguards to protect user data and maintain service integrity. However, no digital platform is completely secure, and we cannot guarantee protection against all unauthorized access, cyberattacks, or system intrusions.

You will be held fully responsible for any legal or financial claims resulting from the content you upload.

13.2 Prohibited Activities (User conduct Restrictions)

You may not use our Services to:

a) Upload or submit the following Prohibited Content that:

  • Is illegal, defamatory, obscene, offensive, hateful, harassing, discriminatory, or promotes violence;
  • Contains pornographic, violent, or otherwise harmful imagery;
  • Includes viruses, malware, trojans, spyware, or other harmful code;

b) Engage in the Following Prohibited Behaviors or Activities:

  • Engage in any unlawful, harassing, harmful, or fraudulent activity;
  • Infringe on the intellectual property rights of others;
  • Distribute spam, malware, viruses, or any malicious code;
  • Attempt to hack, disable, overload, or disrupt our servers or systems;

Our system may use basic automated or manual screening tools before production or order confirmation. However, we do not guarantee real-time review of all submissions. Repeated violations may lead to account suspension or removal.

You are solely responsible for ensuring that your uploaded content — whether images, text, or designs — complies with the law and our policies. By submitting content, you confirm:

  • You own the rights or have consent from anyone appearing in the images
  • You understand that uploading inappropriate or unauthorized content may result in cancellation or suspension
  • You accept that Color Kahar is not liable for any disputes arising from your submissions

If you submit reviews, custom designs, products or testimonials for public display (e.g., on our app, website, or social platforms), that content may be visible to others, indexed by search engines, or shared further. We are not responsible for third-party use of publicly visible data. Please use discretion when sharing personal or sensitive information.

We value creative expression and community engagement, but we also reserve the right to protect the integrity of our brand and Service. You are solely responsible for keeping backups of your photos and design projects. We are not liable for loss, corruption, or deletion of uploaded content due to system failures, expired accounts, user error, or any other cause.

13.6 User Content Disclaimer

We do not claim ownership of your personalized content (unless submitted as public Contributions), nor do we pre-screen or endorse it. However, by uploading content to be printed or processed through our Service, you assume full legal and editorial responsibility for its accuracy, legality, and appropriateness.

Color Kahar will not be liable for any loss, damage, or legal claim related to your uploaded content, even if we produce or deliver the final product based on it.

13.7 No Right to Compete

You may not use our Services to create, market, or support any product, service, or business that competes directly with us, nor may you repurpose our platform, tools, or outputs for competing purposes. Any violation of the above may result in immediate termination of your access and legal action where applicable. Any breach of this clause shall entitle Color Kahar to seek injunctive relief and claim any resulting damages.

14INDEMNIFICATION & TERMINATION

14.1 Indemnification

You agree to defend, indemnify, and hold harmless Color Kahar, its parent company (Color Kahar Private Limited), affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, judgments, costs, or expenses (including reasonable legal fees) arising from or relating to:

  1. Any content (including your contributions and submissions) you upload, including but not limited to photos, designs, and personalized product data;
  2. Your use or misuse of the Services;
  3. Your breach of these Legal Terms or any applicable law;
  4. Violation of any third-party rights, including intellectual property, privacy, or publicity rights;
  5. Any harmful act, abuse, or misconduct toward other users, partners, or service providers;
  6. Any issue, liability, or damage arising after your order has been handed over to third-party logistics providers, including mis delivery, unauthorized access, or theft.
  7. Any issues resulting from delivery errors including unintentional mis delivery to an unintended recipient due to third party courier, Service or human error
  8. Any unauthorized access to, or breach of, our systems, servers, or data, including as a result of hacking, malware, or other security incidents, despite the implementation of reasonable technical and organizational safeguards.

We reserve the right—but not the obligation—to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us, at your expense, in defending such matters. You will be promptly notified of any such claims where feasible.

This indemnity obligation survives the termination of your account and continues indefinitely for content uploaded or actions taken while your account was active.

14.2 Account Termination

Termination does not affect our right to fulfill orders already confirmed and in production before suspension.

15.2 Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profit, revenue, opportunity, or other damages;
  • Loss of data, unauthorized access of personal and public data or content corruption,
  • Those resulting from delivery errors including unintentional mis delivery of products by courier or us;
  • Claims arising from user-uploaded content, including infringement, offensive material, or printing outcomes;

We also do not accept liability for sentimental loss related to personally meaningful content (e.g., wedding photos, baby memories). You are responsible for reviewing and confirming designs and personalized products before submitting your order.

Our total liability for any claim, whether contractual or otherwise, shall not exceed the total amount paid by you for the order giving rise to the claim.

15.3 User-Provided Content

You are solely responsible for the legality, quality, and appropriateness of the content you upload. Color Kahar is not responsible for the content you submit, nor are we obligated to verify or moderate user-uploaded content prior to processing.

Any damages or claims arising from user-submitted materials shall be your responsibility, as outlined in our Indemnification clause.

15.4 Third-Party Services and Links

Our Services may contain links to third-party websites, tools, apps, or promotions. Color Kahar makes no warranties or endorsements for any such third-party content, and we are not liable for the actions, accuracy, privacy practices, or performance of external platforms or vendors.

We are not responsible for any damage, delay, or loss caused by:

  • Upload failures,
  • File corruption during data transmission,
  • Network outages,
  • Bugs, viruses, or malware introduced via third-party sources or users.

15.6 Printed vs. Digital Preview Disclaimer

Our digital preview tools are intended to give you a clear approximation of your final printed product. However, due to variations in display settings, lighting, paper and material finishes, and production processes, minor differences in color, brightness, or alignment may occur.

Such differences are not considered defects and do not qualify for refunds, reprints, or compensation unless the product fails to meet reasonable quality standards.

15.7 Impersonation, Fraud & Unauthorized Platforms

Color Kahar operates exclusively through its officially owned and controlled website(s), mobile application(s), and verified communication channels. Any website, domain, mobile application, social media account, advertisement, email address, phone number, or other communication that imitates, resembles, or falsely claims association with Color Kahar is unauthorized and operated by third parties beyond Color Kahar's control.

Color Kahar expressly disclaims all responsibility and liability for any loss, damage, fraud, data compromise, privacy breach, mis delivery, financial loss, or misuse of user content (including personal photographs) arising directly or indirectly from user interaction with such unauthorized or impersonating platforms.

Users acknowledge and agree that access to, communication with, or transactions conducted through any non-official platform are undertaken entirely at the user's own risk. Color Kahar shall have no obligation to investigate, recover, compensate, or remediate any harm resulting from such interactions.

For the avoidance of doubt, Color Kahar shall not be liable for any unauthorized access, disclosure, duplication, alteration, or delivery of user content, personal data, or photo products where such events arise from phishing, domain spoofing, impersonation, or third-party misrepresentation.

Users are solely responsible for verifying that they are engaging with Color Kahar through its official platforms prior to submitting any personal data, photographs, payment information, or delivery details.

Any suspected fraud, phishing attempt, impersonation, or unauthorized use of the Color Kahar name, brand, or likeness should be reported immediately to support@colorkahar.com. Color Kahar may, at its sole discretion, investigate reported incidents; however, such investigation does not constitute acceptance of liability or responsibility.

15.8 Force Majeure

We are not liable for any delay or failure to perform resulting from events outside our reasonable control, including but not limited to:

  • Acts of God,
  • Natural disasters,
  • Pandemics or epidemics,
  • War, terrorism, or civil unrest,
  • Internet or utility outages,
  • Labor disputes or supplier failures.

During such events, our obligations may be suspended without penalty.

17PHOTO STORAGE & DATA RETENTION POLICY

17.1 Purpose of Storage

When you upload photos, captions, or design content to Color Kahar, the data is stored temporarily and securely for fulfilling your order and Service provision. This includes generating personalized products such as photobooks, prints, mugs, calendars, and similar items.

We do not offer storage as a long-term backup solution or archive for your files. You are responsible for retaining original copies of all photos and projects. We do not guarantee the retrieval of any uploaded content after deletion.

17.2 Order Fulfillment & Deletion

Uploaded content is retained only while:

  • Your order is in production; and
  • The post-delivery dispute window (if applicable) remains open.
  • Retention is required for improvements in operations or Service procedures

Once no longer needed, all associated data is permanently deleted from our systems. This includes the photos and product drafts.

After deletion, we are unable to recover or restore any part of your customized products.

17.3 Inactivity and Retention Limits

If your account remains inactive for a continuous period of 12 months (i.e., no new orders placed), we may permanently delete your saved drafts or any related content of data associated with your account. Where feasible, we may send a courtesy reminder to your registered email before deletion. However, Color Kahar reserves the right to remove content without notice after prolonged inactivity.

17.4 No Liability for Data Loss or Access

While we perform routine system maintenance and apply reasonable security standards, Color Kahar is not responsible for:

  • Accidental deletion, corruption, or loss of photo data;
  • File transmission failures;
  • Network disruptions;
  • Software or hardware malfunctions;
  • Human error;
  • Any other cause beyond our reasonable control.

You agree to waive any claims arising from such instances.

18GOVERNING LAW & DISPUTE RESOLUTION

18.1 Governing Law and Jurisdiction

These Legal Terms and any dispute arising from or in connection with us, including your use of our Services, shall be governed by and defined following the laws of Pakistan. You hereby irrevocably consent that the Courts of Pakistan at Lahore shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

18.2 Dispute Resolution

We value customer satisfaction and will always try to resolve any concerns quickly and fairly before it reaches a legal stage.

Informal Negotiations: To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a 'Dispute' and collectively, the 'Disputes') brought by either you or us (individually, a 'Party' and collectively, the 'Parties'), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Binding Arbitration: Any dispute arising out of or in connection with these Legal Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by Arbitration. The number of arbitrators shall be 1. The seat, or legal place, or arbitration shall be Lahore, Pakistan. The language of the proceedings shall be English. The governing law of these Legal Terms shall be substantive law of the Islamic republic of Pakistan.

Restrictions: The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class-action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions to Informal Negotiations and Arbitration: The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.

If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

18.3 International Users

While Color Kahar currently serves users within Pakistan only, if and when our Services are made available internationally, we will comply with mandatory local consumer protection laws applicable in those regions, where required by law.

However, the default legal jurisdiction remains Pakistan, unless otherwise explicitly mandated by a specific country's laws.

19LEGAL MISCELLANEA & UPDATES CLAUSE

19.1 Entire Agreement

These Terms and Conditions, along with our Privacy Policy, Cookie Policy, Refund Policy, Shipping Policy and any other applicable guidelines or promotional terms, constitute the entire agreement between you and Color Kahar. They supersede all prior or contemporaneous understandings, communications, or agreements, whether oral or written.

RETURN & REFUND POLICY

Color Kahar specializes in customized, made-to-order products. Due to the personalized nature of our service, our returns and refund policies are as follows:

1. All Sales Are Final

Once an order is placed and confirmed, it cannot be cancelled, modified, or returned.

2. No Refunds for Customer Errors

We do not offer refunds for issues such as:

  • Low-resolution images or blurry photos
  • Design dissatisfaction due to user preview oversight
  • Changes in personal preferences

3. Damaged or Defective Products

If your item arrives damaged or defective, please notify us within 7 days of delivery.

  • A clear unboxing video showing the issue

4. Accepted Remedies

Upon review and validation of your claim, we may offer:

  • A voucher, value up to the product price, for future use
  • A refund (only if a reprint or voucher is not possible)

We package all items with care, but once an order is handed to the courier, we are not liable for damage caused in transit. Any courier-related damage claims should be directed to the delivery provider.
